This Nexus Privacy Policy describes how Nexus Booking, Inc. (collectively, “Nexus,” “we,” or “us”) collects, uses, and discloses information about you. This Privacy Policy applies to information we collect when you access or use our websites, mobile applications, and other online products and services that link to this Privacy Policy (collectively, our “Services”), engage with us, or otherwise interact with us.

Our privacy practices may vary in the locations where we operate to reflect local practices and legal requirements. If you are an Advisor, Supplier, or Client located in the European Economic Area (“EEA”), the United Kingdom (“UK”), and Switzerland, please see the Additional Disclosures for Individuals in Europe, the United Kingdom or Switzerland section below.

We may change this Privacy Policy from time to time. If we make changes, we will notify you by revising the date at the top of this policy. We may also provide you with additional notice (such as by adding a statement to the Services or sending you an email), such as in connection with making material changes to this Privacy Policy. We encourage you to review this Privacy Policy regularly to stay informed about our information practices and the choices available to you.

  • The information we collect from you varies depending on the way you use our Services. Nexus is a software application that connects direct customers of Nexus, such as, travel agencies, concierge agencies, lifestyle advisors and personal / executive assistants, (“Advisor(s)”) with event suppliers who interact with Advisors through our Services, including but not limited to, event organizers, ticket brokers, and experience providers (“Supplier(s)”). When you provide your information as an Advisor or Supplier, or their respective employees, consultants, and other third-party contractors, the information we collect and use is different from the information we collect if you are an individual client interacting with our Advisors and Suppliers through our Services (“Client(s)”). Below, we describe the different ways we might collect information from you.

    Information You Provide to Us

    We collect information you provide directly to us.

    Client

    When you interact with Advisors to use our services as their Client, you provide information to them, and Advisors handle your personal information in accordance with their privacy policies. When you book an event as a Client, you may pay Nexus directly. We use a third-party payment processor who collects your payment information and processes your payment for Nexus.

    Advisors

    When you use our services as an Advisor or an authorized user of an Advisor, you provide information directly to us when you use our Services, register for an account with us, fill out a form, submit payment information, send communications to us or content relating to a Supplier, or otherwise communicate or interact with us.

    The types of personal information we may collect include your name, email address, postal address, mobile phone number, picture, social media handles, and any other information you choose to provide.

    Additionally, we collect financial account information or work with a third-party payment processor, such as Stripe, to collect and process payment information to facilitate payment for events and experiences you book on behalf of Clients with Suppliers.

    We also collect information Advisors choose to provide or that we collect on its behalf relating to its own interactions with Clients or other individuals with whom it interacts. Advisors must provide any required notices and collect any necessary consents before collecting or disclosing any such Client information to us. Advisors determine what Client information they collect from their Clients, and to the extent Advisors use Nexus services to receive or stores that information, we do so on behalf of our Advisors. In some instances, Nexus may collect information from Clients on behalf of Advisors in conjunction with or at the same time that Advisors collect the same or similar information from Clients. This Privacy Policy applies as described to Clients, Advisors, and Suppliers, and the Advisor’s privacy policy will apply to its Clients’ information, however collected.

    Suppliers

    If you are a Supplier, we collect certain personal information from you and/or your authorized users of our Services in order to facilitate our business relationship with you, enable you to interact with Advisors, and provide you our products and services (collectively, “Supplier Information”).

    Supplier Information we may collect from you and/or your authorized users includes: name, business name, business mobile phone number, job title, email address associated with your business, postal and billing address, and credit card or payment information.

    Information We Collect Automatically

    We automatically collect certain information about your interactions with us or our Services, including:

    • Activity Information: We collect information about your activity on our Services, such as your interaction with our Services and your communications with us.
    • Device and Usage Information:We collect information about how you access our Services, including data about the device and network you use, such as your hardware model, operating system version, mobile network, IP address, unique device identifiers, browser type, and app version. We also collect information about your activity on our Services, such as access times, pages viewed, links clicked, and the page you visited before navigating to our Services.
    • Location Information: In accordance with your device permissions, we may collect information about the precise location of your device. You may stop the collection of precise location information at any time (see the Your Choices section below for details).
    • Information Collected by Cookies and Similar Tracking Technologies: We (and our service providers) use tracking technologies, such as cookies and web beacons, to collect information about you. Cookies are small data files stored on your hard drive or in device memory that help us improve our Services and your experience, see which areas and features of our Services are popular, and count visits. Web beacons (also known as “pixel tags” or “clear GIFs”) are electronic images that we use on our Services and in our emails to help deliver cookies, count visits, and understand usage and campaign effectiveness.     Information We Collect from Other Sources

    We obtain information from other sources. For example, we may collect information from mailing list providers and social networks. We may also obtain information from Suppliers, Advisors, and Client through referrals.

    Information We Derive

    We may derive information or draw inferences about you based on the information we collect. For example, we may make inferences about your approximate location based on your IP address or infer that you are looking to purchase certain products based on your event activity, browsing behavior, and past purchases.

    Links to Suppliers and Third Parties Sites

    We may make available links to other third-party sites or services. Nexus is not responsible for the privacy practices, content, or availability of Suppliers or other third parties with whom you interact or whose sites or services you visit. Please be advised that if you enter into a transaction on a Supplier site or other third-party site, Nexus does not represent the Supplier, third party, or you. Further, the privacy and security policies of the linked site or Supplier may differ from those practiced by us and are not our responsibility.

  • Use of Information
  • We use the information we collect to provide, maintain, and improve our products and services. We also use the information we collect to:

    • Provide, maintain, improve, and develop new products and services, including to debug and repair errors in our Services;
    • Manage our membership, program and events;
    • Enable Advisors, Clients, and Suppliers to interact with one another on our Services;
    • We use your mobile phone number to call or send you text/SMS messages based on the opt-in or consent you have provided us. You can opt-out at any time by following the instructions provided in our messages;
    • Personalize your experience with us;
    • Send you technical notices, security alerts, support messages and other transactional or relationship messages;
    • Communicate with you about products, services, and events offered by Nexus or Suppliers and others and provide news and information that we think will interest you (see the Your Choices section below for information about how to opt out of these communications at any time);
    • Provide and administer our referral program;
    • Monitor and analyze trends, usage, and activities in connection with our Services;
    • Detect, investigate, and help prevent security incidents and other malicious, deceptive, fraudulent, or illegal activity and help protect the rights and property of Nexus and others;
    • Comply with our legal and financial obligations;
    • Create de-identified, anonymized or aggregated information; and
    • Carry out any other purpose described to you at the time the information was collected.
  • Disclosure of Information
  • We disclose personal information in the following circumstances or as otherwise described in this policy:

    • When you engage with us as a Client or Advisor, you intentionally interact with our Suppliers and use our Services to intentionally interact with Suppliers or direct us to disclose your information to Suppliers to be invited to their events or be included in their promotions. Suppliers will use your information in accordance with their privacy policies.
    • We disclose personal information with vendors that access personal information to perform work for us, such as companies that assist us with web hosting, payment processing, fraud prevention, and customer service.
    • If you provide a review, participate in an event, or otherwise disclose content on our Services, we may disclose this information publicly on our Services.
    • If you choose to use integrations we offer on our Services, such as connecting your social media accounts (e.g., Facebook or Google), we may disclose certain information with the integration partners.
    • We may disclose Advisor and Client personal information and other information you provide in using our Services to interact with Suppliers or that you provide at your direction to Suppliers for their own services and marketing purposes.
    • We may disclose personal information if we believe that disclosure is in accordance with, or required by, any applicable law or legal process, including lawful requests by public authorities to meet national security or law enforcement requirements.
    • We may disclose personal information if we believe that your actions are inconsistent with our user agreements or policies, if we believe that you have violated the law, or if we believe it is necessary to protect the rights, property, and safety of Nexus, our users, the public, or others.
    • We disclose personal information to our lawyers and other professional advisors where necessary to obtain advice or otherwise protect and manage our business interests.
    • We may disclose personal information in connection with, or during negotiations concerning, any merger, sale of company assets, financing, or acquisition of all or a portion of our business by another company.
    • We disclose personal information with your consent or at your direction.

    We also share aggregated or de-identified information that cannot reasonably be used to identify you.

  • Analytics
  • We engage others to provide analytics services across the web and in mobile apps. These entities may use cookies, web beacons, device identifiers, and other technologies to collect information about your use of our Services and other websites and applications, including your IP address, web browser, mobile network information, pages viewed, time spent on pages or in mobile apps, links clicked, and conversion information. This information may be used by Nexus and others to, among other things, analyze and track data (including user engagement and other event activity), determine the popularity of certain content, and better understand your online activity.

    Google Analytics. We use Google Analytics to recognize you and link the devices you use when you visit our Sites or services on your browser or mobile device, log in to your account on our services, or otherwise engage with us. We share a unique identifier, like a user ID or hashed email address, with Google to facilitate the service. Google Analytics allows us to better understand how our users interact with our service and to tailor our advertisements and content to you. We may also utilize certain forms of display advertising and other advanced features through Google Analytics. These features enable us to use first-party cookies (such as the Google Analytics cookie) and third-party cookies together to inform, optimize, and display ads based on your past visits to the services. For information on how Google Analytics collects and processes data, as well as how you can control information sent to Google, go to Google Analytics Privacy Policy or to Google Opt-Outs to learn about Google Analytics’ currently available opt-outs. You may control your advertising preferences or opt-out of certain Google advertising products by visiting the Google Ads Preferences Manager or NAI’s online resources.

    Do Not Track

    Our site does not support Do Not Track (DNT) at this time. DNT is a privacy preference you can set in your web browser to indicate that you do not want certain information about your web page visits tracked and collected across websites.   • Transfer Of Information To The United States And Other Countries
  • Nexus is headquartered in the United States, and we have operations and vendors in the United States and other countries. Therefore, we and those who perform work for us may transfer your information to, or store or access it in, jurisdictions that may not provide levels of data protection that are equivalent to those of your home jurisdiction. Where required by law, we provide adequate protection for the transfer of personal data in accordance with applicable law, such as by obtaining your consent, relying on adequacy decisions, or executing Standard Contractual Clauses.

  • Account Information

    You may update and correct certain account information at any time by accessing your account preferences. If you wish to deactivate your account, you may pause the account in the settings or delete your account, but note that we may retain certain information as required by law or for our legitimate business purposes.

    Communications Preferences

    You may generally opt out of receiving commercial email and other promotional communications from Nexus by following the instructions in those communications. Additionally, if we offer user account functionality on the Services, we may allow you to view and modify settings relating to our communications with you. If you opt out, we may still send you administrative, non-promotional emails, such as those about your account or our ongoing business relations.

    We will call or send you SMS/text transactional or marketing messages to the phone number you provide us based on the opt-in or consent you provide us. You can opt-out at any time.

    Cookies

    Most web browsers are set to accept cookies by default. If you prefer, you can usually adjust your browser settings to remove or reject browser cookies. Please note that removing or rejecting cookies could affect the availability and functionality of our Services.

    California Shine the Light

    California’s “Shine the Light” law requires certain businesses to respond to requests from California residents asking about the businesses’ practices related to disclosing personal information to third parties for the third parties’ direct marketing purposes. Nexus does not disclose your personal information to third parties for those third parties’ to directly market to you.

  • Individuals In Europe, The United Kingdom, Or Switzerland
  • If you are an Advisor, Supplier, or Client located in the European Economic Area (“EEA”), the United Kingdom (“UK”), or Switzerland, the following specific provisions apply to our processing of your personal information, which for purposes of this section shall include “personal data” or “personal information” as defined by applicable privacy laws in the EEA, UK, or Switzerland.

    Legal Basis for Processing

    When we process your personal information as described above, we do so in reliance on the following lawful bases:

    • To perform our responsibilities under our contract with you (e.g., providing the products and services you requested).
    • When we have a legitimate interest in processing your personal information to operate our business or protect our interests (e.g., to provide, maintain, and improve our products and services, conduct data analytics, and communicate with you).
    • To comply with our legal obligations (e.g., to maintain a record of your consents and track those who have opted out of marketing communications).
    • When we have your consent to do so (e.g., when you opt in to receive marketing communications from us). When consent is the legal basis for our processing your personal information, you may withdraw such consent at any time by emailing us at support@nexusaccess.com.

    Data Subject Requests

    You have the right to: (1) request to know more about and access your personal information, including in a portable format, (2) request deletion of your personal information, (3) request correction of inaccurate Personal Information, (4) request restriction of processing of your personal information in certain scenarios, and (5) in certain cases, object to the processing of your personal information for certain purposes.
